Privacy policy

Introduction

S.C. TEAM TELECOM S.R.L., a Romanian legal entity, with registered office in Bucharest, str. Copilului, nr. 6-12, Intr. E, et.1, Domenii Park, 012178, sector 1, registered at the Commercial Registry of the Bucharest Court under no. J40/9771/2001, with CUI RO 14306256, is a personal data controller (hereinafter referred to as “the Operator” or “the Company”) and undertakes to respect the privacy of the users of the websites www.teamtelecom.ro and www.nethub.ro, which it owns.
This privacy policy is based on Regulation 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the “General Data Protection Regulation”), which applies from 25 May 2018.
This privacy policy describes how the Operator collects, processes, transfers and protects the personal data of the users of the websites they provide when using the services www.teamtelecom.ro and www.nethub.ro (hereinafter referred to as “Services”). The Services consist of information products for companies.
The Privacy Policy is an integral part of the Terms and Conditions of Use of the Site.

What personal data do we process?

When you use the Services www.teamtelecom.ro and www.nethub.ro we process the following personal data: name, surname, telephone number, e-mail address, postal address, user name, location, IP address (hereinafter referred to as “Personal Data”).

 

Purposes and grounds for processing personal data

The operator processes Personal Data for the following purposes:

1. Creating and using your user account
When you create an account on www.teamtelecom.ro and www.nethub.ro we collect information such as your first name, last name, phone number, email address, postal address. We process this data pursuant to the execution of a contract, in accordance with Article 6 para. (1) lit. b) of the General Data Protection Regulation. Your refusal to provide us with the aforementioned data will make it impossible to create your user account.
2. Marketing, advertising and publicity
We will collect and use information such as: name, surname, e-mail address, telephone number, to send you commercial information related to our Services, but only after obtaining your express consent by expressing your option in this regard, in accordance with art. 6 para. (1) lit a) of the General Data Protection Regulation.
3. Profiling
In order to improve the quality of our Services, we may combine Personal Data (name, surname, e-mail address, telephone number, which are provided directly by you with other data from other sources such as cookies, but only after obtaining your express consent by expressing your option in this regard, in accordance with art. 6 para. (1) lit a) of the General Data Protection Regulation.
4. Correspondence
We will collect information such as: name, surname, telephone number, e-mail address, postal address in order to communicate to you information related to the provision of our Services, as well as to communicate any changes to this Privacy Policy. We process this data pursuant to the performance of a contract, in accordance with Article 6 para. (1) lit. b) of the General Data Protection Regulation. Refusal to provide the aforementioned data will result in the impossibility of transmitting any information related to the Company’s Services.
5. Compliance with legal obligations
When public authorities request certain information from us, we will process information such as: name, surname, telephone number, e-mail address, postal address, in order to respond to such requests, in accordance with art. 6 paragraph (1), lit. c) of the General Data Protection Regulation. Failure to provide the personal data mentioned above in order to fulfil a legal obligation may lead to negative consequences (sanctions, fines, etc.) for our Company.
6. Carrying out payment operations
In case you make payments on the website www.teamtelecom.ro and www.nethub.ro, the bank information such as: name, surname, IBAN account you provide directly to the payment operator chosen by our company in this regard, for the purpose of carrying out payment operations, and we will not process and retain this information. Your refusal to provide the above mentioned data will lead to the impossibility of completing the requested payment operations.

 

Data storage duration

Personal data will be stored as follows:

1. Creating and using your user account – Personal data will be stored for the time necessary to administer your user account, until you choose to delete it.
2. Marketing, advertising and publicity – Personal data will be stored until you withdraw your consent, but no longer than 5 years from the date you provided it.
3. Profiling – Personal data will be stored until you withdraw your consent, but no longer than 5 years from the date you provided it.
4. Correspondence – Personal data will be stored for the duration of your user account until you delete it.
5. Fulfillment of a legal obligation – Personal data will be stored for the duration mentioned in the legal obligations imposed on the Operator.
The Operator will delete or anonymize all Personal Data for which you have withdrawn your consent, for which the maximum storage period of 5 years mentioned above has expired or which is no longer necessary for the fulfilment of any of the purposes listed above.

 

When and how do we disclose personal data?

Our company will not disclose Personal Data except in the following situations:

a) When we have your express consent to do so;
b) When we are obliged to disclose Personal Data under a legal obligation to the following categories of recipients: public authorities, auditors or institutions competent to carry out controls on the Operator;
c) In order to achieve any of the purposes listed above, our Company may use the services of more than one contractual partner, and Personal Data will be disclosed to them for use within the limits of the obligations they have assumed towards our Company. These partners may be authorised persons and/or independent data controllers. Also, some of the partners are third parties who do not intend to process Personal Data, but may have access to it in the performance of their tasks or interactions with our Company, such as technical maintenance companies, financial or legal auditors. We assure you that we make every effort to ensure that all entities with which we collaborate process Personal Data in a safe and secure manner.
d) When there are disputes and/or other complaints against our Company.

 

Transfer of personal data outside the European Union and/or the European Economic Area

Before transferring Personal Data to a state or international organisations outside the European Union and/or the European Economic Area, we will ensure that all conditions imposed by the General Data Protection Regulation and any applicable personal data protection legislation are complied with.

 

What are your rights?

In accordance with the provisions of the General Data Protection Regulation, you benefit from the following rights as a data subject:
1. RIGHT OF ACCESS – meaning your right to request confirmation as to whether or not Personal Data are being processed, and if so, you may request access to them, as well as certain information about them. You will also receive a copy of the Personal Data at your request;
2. 2. the RIGHT TO RECTIFICATION – meaning your right to obtain the rectification of Personal Data that are inaccurate, as well as the completion of Personal Data that are incomplete, including by providing you with additional information;
3. RIGHT TO DELETE DATA – meaning that in situations expressly regulated by law (in particular if you withdraw your consent or if it is found that Personal Data have been processed unlawfully), you have the right to obtain from the Operator the deletion of Personal Data;
4. RIGHT TO WITHDRAW CONSENT – meaning your right to withdraw, at any time, your consent to the processing of Personal Data, provided that the processing of Personal Data prior to the time of withdrawal of consent remains valid.
5. THE RIGHT TO DATA PORTABILITY – meaning your right to receive the Personal Data you have provided in a structured, machine-readable format and the right to request that the Personal Data be transmitted to another controller of your choice;
6. RIGHT TO RESTRICTION OF PROCESSING – Meaning your right to obtain from the Controller the restriction of the processing of Personal Data in certain situations expressly regulated by law (in particular if you dispute the accuracy of the Personal Data or if the processing is unlawful, but you object to the deletion of the Personal Data). In these situations, with the exception of storage, the Personal Data will no longer be processed.
7. RIGHT TO OPPOSITION – meaning your right to object to the processing of data in certain cases, including profiling (direct marketing, scientific, historical or statistical research, legitimate interest of the controller, public interest or resulting from the exercise of public authority vested in the controller).
8. RIGHT TO COMPLAINT – meaning your right to lodge a complaint against the way in which Personal Data is processed. The complaint shall be submitted to the National Supervisory Authority for Personal Data Processing.

Security measures

Our company will take all necessary technical and organizational measures to protect Personal Data against loss, theft, misuse, unauthorized access, unauthorized disclosure, alteration and destruction. To this end we will use methods such as encryption, paroling and limiting access to Personal Data. We will also periodically update and test the security of the technologies we use. We will also inform and train our staff about the importance of confidentiality and protection of your Personal Data.

Data processing of children under the age of 16

All processing activities described in this privacy policy are only aimed at persons who are at least 16 years old. The use of Personal Data, as well as the results of their processing, is strictly prohibited with respect to children under the age of 16 without the consent of their parents/legal representatives. However, in the exceptional case that such processing of Personal Data takes place, we will stop it immediately.

 

Modification of the privacy policy

We reserve the right to modify and/or supplement this Privacy Policy at any time, for any reason, without any notice other than posting the Privacy Policy as modified and/or supplemented on our website.
